01About these terms

Top Notch Products is operated by its parent company, Northside Ambition Productions, in Ontario, Canada. “We,” “us,” and “our” refer to that business operating Top Notch Products.

These Terms of Service apply to your use of topnotchproducts.ca. By using the website, you agree to follow these terms. If you do not agree, please stop using it. These terms concern this website; any purchase is also subject to the relevant listing, transaction terms, marketplace or payment-provider rules where relevant, and applicable law.

02What this website provides

The website introduces our business, provides contact information, links to our marketplace profiles, and offers links to PayPal and Square for direct payments agreed with us. It has no shopping cart, customer accounts, or payment-card entry form. Shop and payment links take you to separate services.

General descriptions on this site are for information. They do not reserve an item or create a purchase agreement. Check the actual listing and contact us through the relevant platform if you need details before buying.

03Purchases and direct payments

Marketplace orders. Availability, condition, included items, pricing, taxes, shipping or pickup, cancellations, and returns are set out in the applicable listing and platform transaction process. Complete marketplace orders through that platform and use its messaging and buyer-protection process.

Arranged direct purchases. Before using a payment button, contact us to confirm the item, its condition and availability, the total in Canadian dollars (CAD), any tax or delivery charges, delivery or pickup arrangements, and the applicable cancellation and return terms. Enter only the agreed total and the order reference we give you. These buttons are for one-time purchase payments, not donations or subscriptions.

PayPal or Square handles the payment on its own checkout page under its terms. Review the recipient, amount, currency, and details before confirming. Do not send card numbers or passwords by email. We use the provider’s transaction record to confirm receipt before arranging fulfilment; a payment does not guarantee an unconfirmed item is available.

If the amount or reference is wrong, a payment is duplicated, or you have an issue with a direct purchase, contact contact@topnotchproducts.ca with the payment reference. We will review the issue and arrange any correction or refund that is agreed or required by law through the appropriate payment provider. For an existing marketplace order, contact us through that marketplace.

Payment-provider and marketplace policies do not remove any statutory rights or seller obligations. Nothing here prevents you from using a dispute process or remedy available under applicable law or your provider’s terms.

04Responsible use

You may browse the site, follow links, and contact us for legitimate purposes. Do not:

  • Use the site to break the law, commit fraud, impersonate someone, or send threatening or unlawful material.
  • Attempt unauthorised access, distribute malicious software, bypass security controls, or interfere with the site’s operation.
  • Use automated requests in a way that disrupts the service or harvest personal contact details for spam.
  • Copy or reuse protected material in a way that infringes someone’s rights.

We may take reasonable steps to restrict misuse or protect the service, subject to applicable law. Marketplace accounts and transactions remain governed by their own access rules.

05Content and brand ownership

Our original website text, design, and branding belong to Northside Ambition Productions or their respective licensors. You may view the site and make reasonable personal, non-commercial copies where the law permits. Other uses require permission unless a legal exception applies.

Marketplace names, logos, and third-party product brands belong to their respective owners. Their appearance identifies the platform or product; it does not imply endorsement, partnership, or authorised-dealer status. “Official merchandise” describes the relevant goods and does not mean this website is operated by those brands.

06External services and information

Linked marketplaces and payment providers operate independently. Their services, accounts, security, fees, and policies are subject to their own terms. We are responsible for our own conduct and listings as a seller, but cannot control a platform’s availability or every action it takes.

We aim to keep this website accurate, but information can change or contain errors. Feedback percentages and marketplace badges describe a particular platform and may change over time; they are not a guarantee of a future experience. Let us know if you find an error.

07Availability and liability

We cannot promise uninterrupted access or that the website will always be free from errors. We may maintain, update, or withdraw website features, while respecting obligations already owed to you.

To the extent permitted by law, we do not give additional warranties about this website’s availability, accuracy, or suitability for a particular purpose. We are not responsible for losses caused by third-party service failures outside our reasonable control, except where the law makes us responsible.

Nothing in these terms excludes or limits rights, warranties, remedies, or liabilities that cannot lawfully be excluded or limited. These terms do not waive consumer protections, prevent a lawful complaint, require mandatory arbitration, or restrict a right to bring proceedings where applicable law protects that right.

08Privacy and communications

Our Privacy Policy explains how we handle personal information. Share only the details needed for your enquiry. Contacting us does not sign you up for marketing communications.

For website or general business questions, email contact@topnotchproducts.ca. For an order, include its reference and the marketplace or payment provider used without sending payment credentials.

09Applicable law and changes

Subject to mandatory laws that apply to you, these terms are governed by the laws of Ontario and the federal laws of Canada applicable there. This does not take away consumer rights or access to a court or regulator available under mandatory law in your place of residence.

We may update these terms for future use of the website and will revise the date above. Changes do not retroactively alter a completed purchase or remove accrued rights. If any provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
